1. Acceptance of Terms

By accessing or using Palimory ("the Service"), operated by jngl gGmbH, Fraenkelufer 30, 10999 Berlin, Germany, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Palimory is a multilingual story publishing platform that enables authors to publish original works, translators to contribute translations, and readers to discover and support creative content across languages.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account.

4. User Content

4.1 Ownership

You retain ownership of all content you submit, post, or display on the Service ("User Content"). By submitting User Content, you grant Palimory a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute your content solely for the purpose of operating and improving the Service.

4.2 Author Responsibilities

As an author, you represent and warrant that:

  • You own or have the necessary rights to publish your content
  • Your content does not infringe upon the intellectual property rights of any third party
  • Your content does not violate any applicable laws or regulations

4.3 Translation Rights

Authors may set translation policies for their works (closed, approval required, or open). Translators must respect these policies and obtain necessary permissions before creating translations. Translations remain derivative works, and translators acknowledge the original author's rights.

4.4 Prohibited Content

You may not post content that:

  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy
  • Infringes any patent, trademark, trade secret, copyright, or other proprietary rights
  • Contains software viruses or any other malicious code
  • Promotes illegal activities or violates the rights of others
  • Contains sexually explicit content involving minors
  • Constitutes hate speech or promotes violence against individuals or groups

5. Payments and Revenue Sharing

5.1 Monetization

Eligible users may receive payments through tips and other monetization features. Revenue is shared between authors, translators, and the platform according to the applicable split template.

5.2 Payment Processing

Payments are processed through third-party payment providers. You agree to comply with any applicable terms of service from these providers. Palimory is not responsible for errors or issues arising from payment processing.

5.3 Taxes

You are responsible for determining and paying any taxes applicable to payments you receive through the Service.

6. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by jngl gGmbH and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. DMCA and Copyright Complaints

We respect the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us at legal@palimory.eu with:

  • A description of the copyrighted work you claim has been infringed
  • The URL or location of the allegedly infringing material
  • Your contact information
  • A statement that you have a good faith belief that the use is not authorized
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act
  • Your physical or electronic signature

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and associated data in accordance with our Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JNGL GGMBH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or similar issues transmitted through the Service
  • Any content posted on the Service by users

11. Indemnification

You agree to indemnify, defend, and hold harmless jngl gGmbH and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
